
Project Description
This Ordinance built upon the straws-on-request ordinance and is based on the same environmental considerations, and potential benefits to businesses. Food vendors don’t need to provide utensils, napkins or standard condiments to the delivery customers, because the customers have those supplies at home. (“Special condiments” refers to sauces, for example, that are unique or integral to some meals; these can be provided without the customer requesting them..) Using customers’ foodware reduces foodware purchases by vendors, thus reducing expenditures.
Effective November 15, 2021, food and beverage facilities with more than 28 employees must comply with the Ordinance, including their third-party ordering platforms and/or third-party delivery services. An opt-in option for accessories is allowed. Facilities are allowed to ask drive-through customers if they want any accessories.
Licensed Health Facilities, and Residential Care Facilities for the Elderly as defined in Sections 1250 and 1569.2 of the California Health and Safety Code, are exempt from the requirements of this ordinance.
